About these Terms
These Terms govern use of the ARTE CASA online store and purchases from SOMATÓRIO CELESTIAL UNIPESSOAL LDA, trading as ARTE CASA.
By placing an order, the customer confirms that they have had an opportunity to read and accept these Terms, the Shipping Policy, Return & Refund Policy, Privacy Policy and any product-specific instructions or warnings.
Mandatory consumer rights always prevail over any conflicting provision in these Terms.
Eligibility
An order may be placed by:
• An adult with legal capacity
• A lawful representative acting for a minor
• A company or organization acting through an authorized representative
The customer must provide accurate, current and complete information.
Products and handmade characteristics
ARTE CASA makes reasonable efforts to describe and display each product accurately. Screen settings, lighting and photography may affect perceived color.
Ceramic and wooden components are handmade or finished by hand. Small variations in shade, glaze, pattern, texture, shape, dimensions and natural wood grain are expected and form part of the product’s character.
Cracks, chips, leakage, dangerous sharp edges, a defective tap or a material mismatch with the ordered model are not treated as normal handmade variation.
Bottles and decorative objects shown in photographs are not included unless expressly stated. The dispenser is intended for compatible standard office water bottles made of plastic or glass, including approximately 11.4 L / 3 US gallons and 18.9 L / 5 US gallons.
Availability
Products that are not available are marked “Sold out”. We do not accept backorders or pre-orders unless expressly stated.
Adding an item to the cart does not reserve it. Availability is confirmed when ARTE CASA accepts the order.
Prices, VAT and shipping
Prices are displayed according to the selected market and currency.
For Portugal and EU consumer sales, prices include applicable VAT where required. Standard shipping is included in the displayed product price for all supported markets.
For the United Kingdom, United States, Canada and Switzerland, import VAT, customs duties, brokerage fees and other import charges may be payable by the recipient unless expressly collected at checkout or required by law to be collected by ARTE CASA.
ARTE CASA may change prices at any time, but a change does not affect an order already accepted.
If an obvious pricing, description or technical error occurs, ARTE CASA may reject or cancel the affected order and issue a full refund.
Payment
Available payment methods are shown at checkout and may depend on the customer’s location. They may include payment cards, Apple Pay, Google Pay, Shop Pay, Multibanco, PayPal, bank transfer and Klarna.
Orders paid by bank transfer are processed after cleared funds are received.
Payment providers process card and account information under their own terms and privacy rules. ARTE CASA does not store complete payment-card details.
If payment is declined, reversed, unauthorized or reasonably suspected to be fraudulent, ARTE CASA may suspend or cancel the order.
Order acknowledgement and acceptance
The automated order confirmation acknowledges receipt of the order; it does not necessarily mean that ARTE CASA has accepted it.
The sales contract is formed when ARTE CASA expressly accepts the order or sends the dispatch confirmation, unless mandatory law provides otherwise.
Before acceptance, ARTE CASA may reject or cancel an order and refund all amounts paid if:
• The product is unavailable
• There is an obvious pricing or description error
• Payment fails or appears fraudulent
• The address is invalid or not serviceable
• Required customer information is missing
• Fulfilling the order would be unlawful or unsafe
Personalization and made-to-order work
Personalization is considered individually. Specifications, price, production time and any special conditions are agreed in writing.
Once the customer has approved the specification and production has started, a genuinely personalized or made-to-order product may not be cancelled or returned for change of mind. Rights relating to defects, damage, safety and conformity remain unaffected.
Shipping, delivery and risk
The Shipping Policy forms part of these Terms.
ARTE CASA chooses the carrier. Delivery estimates are not guaranteed. An order may arrive in more than one parcel.
For consumer orders, risk passes only at the time required by mandatory law, generally when the customer or a person designated by the customer takes physical possession of the goods.
Returns, refunds and statutory rights
The Return & Refund Policy forms part of these Terms.
ARTE CASA does not provide an additional commercial warranty. Customers retain all mandatory legal guarantees and remedies under applicable law.
No term excludes liability for unsafe, defective, damaged, misdescribed or non-conforming goods where such liability cannot legally be excluded.
Product use, assembly and safety
The customer must follow the product page, enclosed assembly instructions and Product Safety & Care Notice.
The customer must assemble the stand correctly, install the tap and seals correctly, verify stability and conduct a leak check before normal use.
ARTE CASA is not responsible for damage caused by misuse, incorrect assembly, unauthorized modification, excessive load, impact, freezing, thermal shock, dishwasher use, unsuitable liquids or use contrary to the instructions, except where responsibility cannot be excluded by law.
Business customers
Small business orders may be placed through the website.
Large, wholesale or individually negotiated business orders are subject to a separate quotation and written commercial terms. Where the customer is acting wholly or mainly for business purposes, consumer-only rights do not apply.
For business customers, to the maximum extent permitted by law:
• ARTE CASA is not liable for indirect or consequential loss, lost profit, lost revenue or business interruption.
• ARTE CASA’s aggregate contractual liability is limited to the amount paid for the affected order.
These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury, defective-product liability that cannot be excluded, or any other liability that cannot legally be limited.
Discounts and promotional codes
Promotional codes apply only during the stated period and on the stated conditions.
Discounts cannot be combined unless expressly stated. A code cannot be applied retroactively to a completed order.
Products bought at a discount remain subject to the ordinary return policy.
Intellectual property
All website content, including the ARTE CASA name, logo, text, photographs, product imagery, videos, graphics and design elements, is owned by or lawfully licensed to ARTE CASA.
No content may be copied, modified, distributed, resold, scraped or used commercially without prior written authorization.
Acceptable website use
The customer must not:
• Use the website for unlawful or fraudulent activity
• Interfere with website security or operation
• Introduce malicious code
• Scrape, copy or exploit the store or its content without authorization
• Submit false, misleading or abusive information
ARTE CASA may restrict access or cancel an order where misuse is reasonably suspected.
Third-party services
The store may use Shopify and third-party payment, analytics, delivery, review or marketing services. Those services may be governed by their own terms and privacy notices.
ARTE CASA is not responsible for an independent third-party service to the extent allowed by law, but this does not reduce ARTE CASA’s obligations as seller.
Events outside reasonable control
Neither party is liable for delay or failure caused by events outside reasonable control, provided the affected party takes reasonable steps to reduce the impact.
If ARTE CASA cannot fulfil an accepted order or the delay becomes excessive, it may cancel the undelivered portion and refund the corresponding amount. Mandatory consumer rights remain unaffected.
Governing law and disputes
These Terms are governed by Portuguese law.
A consumer retains the protection of mandatory provisions of the law of the country in which the consumer habitually resides where those provisions apply. Nothing in these Terms requires a consumer to bring proceedings exclusively in Portugal where mandatory jurisdiction rules provide otherwise.
For B2B disputes, the courts of the judicial district of Leiria, Portugal, have jurisdiction, except where another court has mandatory jurisdiction.
Portuguese consumers may use the CNIACC consumer ADR service identified in the Legal Notice.
Changes to these Terms
ARTE CASA may update these Terms from time to time. The version applicable to an order is the version made available when the order was placed.
Later changes do not retrospectively reduce rights under an existing contract.
Severability and no waiver
If any provision is invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.
A delay in enforcing a right does not waive that right.
